Services Provided

 

ZK Design provides graphic design and website design services, which include:

- Custom website design and development

- Logo design and branding

- Graphic design for marketing materials, such as brochures, flyers, and social media assets

- Ongoing website maintenance (if agreed)

- Other design services as agreed upon between you and ZK Design

 

Project Scope and Deliverables

 

Once you engage ZK Design for a website or graphic design project, the scope, deliverables, and timeline will be outlined in a separate **Project Agreement** or **Contract** between you and us. This agreement will include:

- The specific design services being provided

- Project timelines and milestones

- Delivery formats for final designs (e.g., files, websites)

- Payment structure and terms

 

You agree to provide any necessary information and feedback in a timely manner to ensure the project progresses as planned.

 

Prices and Payment

 

All prices for design services, including website design and other graphic design services, will be outlined in the **Project Agreement** or **Contract**. Prices are quoted in GBP (£) and may include VAT unless otherwise stated.

 

Payment for services is due in accordance with the terms outlined in the agreement. Generally, we may require an upfront deposit (typically 50%) before starting the project, with the balance due upon completion. We accept payments via bank transfer, credit card, or other methods as specified in the agreement.

 

Client Responsibilities

 

You agree to:

- Provide accurate and complete content, images, and other materials needed for the project.

- Respond promptly to requests for feedback and approvals during the design process.

- Ensure that any third-party materials or content you provide for use in the design are owned by you or that you have the necessary rights to use them.

 

Failure to provide required content or feedback in a timely manner may result in delays or additional charges.

 

Intellectual Property Rights

 

Upon full payment for services, you will own the final designs, including any custom websites and branding, subject to any third-party licenses or restrictions (e.g., fonts, stock images). However, we retain the right to use your project for portfolio or marketing purposes unless otherwise agreed in writing.

 

You may not use any part of the design process or unfinished drafts without our permission unless otherwise specified in the agreement.

 

Revisions and Modifications

 

We understand that revisions may be necessary during the design process. The number of revisions included in the project will be outlined in the **Project Agreement**. Additional revisions beyond the agreed scope may incur extra charges. 

 

Revisions are generally limited to:

- Design modifications to meet your specifications.

- Changes based on feedback received within the scope of the project.

 

Major modifications or changes in direction after project commencement may result in additional charges or adjustments to the timeline.

 

Privacy and Confidentiality

 

We value your privacy and will protect any personal or business information you provide. We will not share or sell your information to third parties without your consent, except as required by law. 

 

All information shared during the design process, including design ideas, concepts, and business data, will be kept confidential.

 

Third-Party Services and Licensing

 

For some projects, third-party services, such as web hosting or premium theme licenses, may be necessary. If applicable, you will be responsible for securing these services unless otherwise agreed upon. We will notify you of any third-party service fees or licenses that may be required for your project.

 

Limitation of Liability

 

To the fullest extent permitted by law, ZK Design shall not be liable for any direct, indirect, incidental, special, or consequential damages, or any loss of profits, data, or goodwill arising from:

- Your use or inability to use the Site or any design services.

- Errors or omissions in the content, design, or development of any project.

- Any third-party products or services accessed through our services.

 

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

 

Termination of Services

 

Either party may terminate the agreement for a specific project, subject to the terms outlined in the **Project Agreement**. If you choose to terminate a project, you will be responsible for paying for all work completed up to the point of termination. If we choose to terminate, we will refund any payments made for work not yet completed.

 

Governing Law and Dispute Resolution

 

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with these Terms shall be resolved in the courts of the United Kingdom.

 

Severability

 

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remainder of the Terms shall remain in full force and effect.

 

Changes to Terms
